2. Definitions

• Author: The person who creates or writes the work being published.

• Publisher: The person or entity responsible for publishing and distributing the work.

• Author’s Agent: A representative authorized to act on behalf of the Author in matters related to the publication and distribution of the work.

• End User: Any user of the Site who reviews, purchases, or accesses any Work.

3. Rights and Obligations of Authors, Publishers, and Agents

By uploading content to BlueCloudPublishers, you, as the Author, Publisher, or Agent, confirm the following:

• You are the legal publisher of the Work.

• You control all rights and assume all liabilities associated with the publication of the Work.

• The content does not infringe upon the rights of others.

• You are responsible for editing, formatting, and designing the cover of your book, as well as for uploading it to the platform, managing metadata, and marketing the book.

4. Grant of Rights

By submitting your work to BlueCloudPublishers, you grant us the non-exclusive worldwide right to publish, distribute, market, and sell your work, and to license others to do so. This is a non-exclusive agreement, meaning you can publish, license, and distribute your work elsewhere without violating this agreement.

5. Publication and Distribution

• 5a. Publication of Work: BlueCloudPublishers will generally publish your Work as submitted, with minor adjustments for file conversions, though we do not guarantee the exact preservation of formatting.

• 5b. Decision to Publish: We may decide not to publish your work or to remove it at our discretion. We will attempt to notify you if your work is rejected or removed.

• 5c. Unpublishing Work: You can remove your work from the Site at any time by logging into your Dashboard and selecting the “Unpublish” option. If you are unable to do so, contact BlueCloudPublishers, and we will remove your work within 7 business days. Note that removal from distribution partners may take several weeks.

6. Royalties and Payments

• 6a. Royalties: BlueCloudPublishers will pay you royalties based on the net proceeds from sales of your work. You will receive up to 70% of the net proceeds, with actual amounts dependent on factors such as processing fees and retailer discounts.

• 6b. Payment Timing: Royalties are calculated monthly and paid within 15 working days after the end of each calendar month.

• 6c. Tax Withholding: All authors and publishers are required to complete the necessary tax certifications. Taxes will be withheld as required by law.

7. Copyright

• 7a. Ownership: The copyright of the Work remains with the Author or the party the Author designates as the copyright holder.

• 7b. Protection: The Author is responsible for registering their copyright and intellectual property rights with the relevant governmental bodies.

8. Infringement and Legal Issues

• 8a. Infringing Works: If BlueCloudPublishers receives notice of infringement or defamatory material from a third party, we will remove the work in question.

• 8b. Responsibility: It is the Author’s responsibility to secure the necessary permissions for any third-party material included in their work.

• 8c. Legal Compliance: Authors must ensure their work complies with all applicable laws, including those regarding privacy, defamation, and intellectual property.

9. Author and Publisher Warranties

By uploading content, you warrant the following:

• You are the exclusive author, publisher, or authorized agent of the work.

• The work does not violate any copyright, trademark, privacy, or other legal rights.

• The work is complete, original, and not plagiarized.

• The work is not defamatory, discriminatory, or harmful.

10. End-User Rights

• 10a. Use of Purchased Works: As an End-User, you are granted a non-transferable, non-exclusive right to use the purchased Work for personal, non-commercial purposes only. You may not resell or redistribute the Work.

• 10b. Fees and Charges: You agree to pay the fees set by the Author or Publisher for the Work. All purchases are final, and BlueCloudPublishers reserves the right to change pricing and fee structures.

11. Author-Controlled Terms

Authors can control various aspects of their work, including pricing, distribution channels, and sampling rights.

12. Account Security

You are responsible for keeping your account details (email, password, etc.) secure. BlueCloudPublishers is not responsible for unauthorized access to your account.

13. Termination

BlueCloudPublishers reserves the right to terminate or suspend your account if you violate these Terms and Conditions, including by uploading infringing or inappropriate content.

14. Special Guidelines for Erotic Literature

BlueCloudPublishers allows a wide range of erotic literature but has strict guidelines, including prohibiting graphic images of nudity and underage content. We reserve the right to review and remove any content that does not comply with these guidelines.
